DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS ARTICLE VIIIASSIGNABILITY AND WAIVERDeclarant may at any time or times assign or waive any or all of its rights or powers or its easements under this Declaration by recording a notice of same with the Wayne County Register of Deeds. ARTICLE IXSEVERABILITYThe voiding or invalidation of any one or more of the covenants, conditions or restrictions, or parts thereof, contained herein, by judgment or court order, shall in no way affect any of the remaining provisions, and all of said restrictions shall remain totally and severally enforceable, All construction shall be in accordance with the Ordinances of the Township and these covenants, conditions and restrictions, and wherever a conflict shall exist, the more restrictive of the two shall apply. ARTICLE XNOTICESAny notice required to be sent to any Member or Owner under the provisions of this Declaration shall be deemed to have been properly sent when mailed, postage
prepaid, to the last known address of the Person who or which appears as Owner on the
records of the Association at the time of such mailing. |
